Microsoft hasn't said whether both games will be released in tangent or not, but upon availability, the digital download will be the players to keep as long as they wish "no matter what." The way to download it, is by adding it to you queue, and clicking "use Microsoft Points" even if you don't have any available - and start downloading. You still have to be an Xbox Live Gold member though, otherwise it will run you 3600 MS Points. No idea if this is a mistake or not as we have yet to see a promo for it, but go ahead and try.
